Terms of Use

Welcome to AI@Work!

1. Definitions

  • “AI @ Work” is a product owned by Brainster, consisting of a digital learning platform (LMS) and educational content in the form of AI Courses and AI Academies, designed to enable professionals to acquire practical skills in the field of artificial intelligence. The platform serves as a central environment for publishing, managing, implementing, and monitoring educational content subject to these Terms.
  • “AI Courses”, for the purposes of these Terms, means educational content with a duration of between 40 minutes and 4 hours, consisting of various components including, but not limited to: Micro-courses, Practical AI Workshops + Q&A sessions, Real-world Case Studies, Deep-dive Masterclasses, as well as Virtual Conferences and Panels.
  • “AI Academies”, for the purposes of these Terms, means specialized educational programs with a continuous duration of at least six (6) weeks, delivered at least once per week during the scheduled period, with a predetermined start and end date, as well as a predetermined class schedule. The number, content, and duration of modules within each AI Academy are determined by Brainster.
  • “User” is any natural person who has registered for a subscription and uses the services of AI@Work..
  • “Service Commencement Date” shall mean September 1, 2025. As of this date, AI @ Work shall be deemed active and the services set forth herein shall be provided.

2. Description of Services

  • As of the Service Commencement Date, Brainster shall organize no fewer than eight (8) different online AI Courses and/or online AI Academies each month, with AI Academies commencing no earlier than six (6) months after the Service Commencement Date. Each AI Course and AI Academy will have a predetermined schedule and duration.
  • The detailed calendar, schedule, and dates of AI Courses and AI Academies, the type of AI Courses and AI Academies, as well as the instructors (service providers), will be published no later than the last calendar day of the month preceding the month in which they will be delivered.
  • Brainster reserves the right to make changes to the calendar, schedule, courses, topics and instructors (service providers) of AI Courses and AI Academies after publication, in order to improve quality, update content, and ensure uninterrupted and continuous service delivery to the User.
  • AI Courses and AI Academies are delivered live and as a general rule, are not recorded, stored, or archived in any form. Upon completion of each individual session, the content will no longer be accessible for review or use by Users. By way of exception, certain courses or sessions may be recorded and made available for replay within 24 to 48 hours after completion. Any form of recording or reproduction by Users is strictly prohibited without prior written consent from Brainster.
  • With a minimum subscription of six (6) months for an individual User of AI Courses, or by continuously using the AI@Work platform for at least six (6) months without interruption, the User becomes entitled to one (1) AI Academy free of additional charge, which may be chosen from the offered selection. Each User is entitled to a maximum of one (1) AI Academy free of charge within a calendar year. The schedule, duration, and other information regarding each AI Academy will be published on the AI@Work platform.
  • Brainster issues a digital certificate for each AI Course or AI Academy successfully completed by the User. To obtain the certificate, the User must successfully pass a quiz or another type of assessment provided at the end of the AI Course or AI Academy. As a general rule, each User is entitled to three (3) attempts, and a passing grade requires a score of at least thirty percent (30%). Brainster reserves the right, for specific courses or different types of programs, to establish an alternative form of assessment, a different minimum score, or other conditions for obtaining the certificate. The detailed conditions for obtaining a digital certificate may be published in the description of the respective AI Course or AI Academy, in separate terms and conditions, or in other sections of the official AI@Work website, as determined at Brainster’s sole discretion.

3. General Provisions

  • By registering and using the AI@Work platform, the User agrees to these Terms.
  • Brainster reserves the right to amend these Terms at any time. Users will be notified of all material changes via email or through a notice published on the AI@Work platform.
  • By continuing to use the Platform after the publication of amendments, the User is deemed to have fully accepted the revised Terms.

4. Subscription and Payment

  • AI@Work and all its content will officially become available to all Users from September 1, 2025. If you register before this date, payment will be processed on September 1, 2025, and your subscription will commence from that date.
  • The subscription start date is the date on which payment is successfully processed from the registered payment card.
  • Upon registration, the User may choose one of the following subscription models:
    • Monthly Subscription: Paid in advance for one (1) month and automatically renewed each month. Payments are non-refundable except as required by applicable law.
    • Six-Month Subscription: Paid in advance in full for six (6) months and automatically renewed every six months. Payments are non-refundable except as required by applicable law.
    • Annual Subscription: Paid in advance in full for twelve (12) months and automatically renewed each year. Payments are non-refundable except as required by applicable law.
  • Subscriptions automatically renew upon expiry of the chosen period (monthly, six-month, or annual). Renewal occurs on the same calendar day as the expiry of the previous period. If such a day does not exist in the renewal month, the subscription renews on the last calendar day of that month.
  • Payments are processed online via Mastercard or Visa payment cards registered on the AI@Work platform.
  • The subscription price displayed on our official website is expressed in euros (€) for informational purposes only.
  • All transactions and payments are processed in Macedonian Denars (MKD), in accordance with applicable regulations. If your payment card is denominated in a currency other than MKD, your bank or card issuer will apply its own exchange rate for converting the amount from MKD to your card currency.
  • Brainster reserves the right to offer promotional discounts, special offers, or coupons to reduce subscription prices. Such promotions may apply to all Users or to specific categories of Users, for a limited or unlimited period, subject to the specific terms of each promotion. Discounts and coupons are non-transferable, non-exchangeable for cash, and valid only under the published terms of their use.
  • A subscription may be canceled at any time via the account settings of your User account. Cancellation becomes effective at the end of the current paid period. This means you will retain full access to the service until the end of the period already paid for, and you will not be charged for the subsequent cycle.
  • Brainster reserves the right to change subscription prices. Users will be notified of any changes at least thirty (30) days in advance via email. If you do not agree to the new price, you may cancel your subscription before the change takes effect. Continued use of the service after the effective date of the new price shall be deemed acceptance of the change.

5. User Account and Security

  • To use the AI@Work services, each User must create a personal User account by registering on the platform. During registration, the User must provide accurate, complete, and up-to-date information. The User is responsible for the accuracy of the submitted data and must promptly update it in the event of changes.
  • The User account is personal and non-transferable. Users must not allow third parties to use their account, and sharing login credentials (username and password) with third parties is strictly prohibited and constitutes a material breach of these Terms. The User is solely responsible for all activities carried out through their account.
  • The User is required to maintain the confidentiality of their password and all other access credentials. If there is any suspicion of unauthorized use of the account or any security breach, the User must immediately notify Brainster through the official support channels.
  • Brainster implements all reasonable technical and organizational measures to protect the security of User accounts and data, in accordance with applicable data protection regulations. However, Brainster cannot guarantee absolute security and shall not be liable for damages caused by account misuse due to the User’s negligence or misconduct.
  • Brainster reserves the right to suspend or permanently disable a User account if it determines that the User has violated these Terms, engaged in activities that may compromise the security or functionality of the platform, or misused the services, without any obligation to refund paid fees.

6. Intellectual Property

  • All intellectual property rights related to the AI@Work platform, including but not limited to: content, design, graphics, logos, trademarks, audio and video materials, curricula, presentations, course and academy recordings (if any), documents, texts, tools, and all other digital materials and resources created or made available through the platform, are owned by Brainster or its partners, service providers and collaborators who have granted appropriate usage rights.
  • By activating a subscription, Users are granted a limited, non-transferable, and non-exclusive right to use the services and content solely for personal and educational purposes, in accordance with these Terms, which terminates immediately upon the expiration or cancellation of the subscription.
  • Copying, reproducing, recording, distributing, modifying, publicly displaying, reselling, or any other form of commercial or unauthorized use of the content and services provided through AI@Work, without prior written consent from Brainster, is strictly prohibited.
  • The names, logos, and all other marks associated with the brands “Brainster” and “AI@Work” are protected trademarks. Their use, copying, or imitation, in whole or in part, without prior written authorization from Brainster, is strictly prohibited.
  • If a User submits, shares, or publishes materials through the platform (e.g., ideas, comments, feedback, or content created during a course), the User grants Brainster a non-exclusive, unrestricted, transferable, and royalty-free license to use, reproduce, modify, adapt, and distribute such materials, solely for the purpose of improving and developing the platform and services as well as for promotional purposes.
  • Brainster reserves the right to take appropriate legal action in the event of intellectual property infringement, including suspension or permanent disabling of a User account, as well as initiating legal proceedings for damages.

7. Limitation of Liability

  • Brainster will use reasonable efforts to ensure the uninterrupted operation of the AI@Work platform, regular availability of content, and timely delivery of services. However, the services are provided “as is” and “as available,” without any express or implied warranties regarding uninterrupted access, accuracy, suitability, or fitness for a particular purpose.
  • Brainster shall not be liable for:
    • technical issues or temporary interruptions in platform operation caused by reasons beyond its control (including internet outages, technical failures, third-party attacks, force majeure, etc.);
    • losses or damages arising from the use of, or inability to use, the platform;
    • content, statements, or actions of third parties (including instructors, i.e. service providers and external collaborators);
    • any indirect, incidental, special, or consequential damages, including lost profits, business opportunities, or data.
  • The total liability of Brainster in connection with the use of services shall not exceed the total amount paid by the User for the subscription during the subscription period in which the event giving rise to liability occurred.
  • The User is responsible for their own equipment, internet connection, and safe management of their login credentials (username, password, payment details). Brainster shall not be liable for damages resulting from unauthorized access to the User’s account where such access is due to the User’s negligence.

8. Data Protection

  • Brainster processes Users’ personal data exclusively in accordance with the Law on Personal Data Protection of the Republic of North Macedonia and applicable European privacy standards, including the principles of the General Data Protection Regulation (GDPR).
  • Personal data collected during registration, payment, and use of the services (full name, contact details, payment card information, service usage records) is processed solely for the following purposes:
    • ensuring the proper provision of services through the AI@Work platform;
    • processing subscription payments;
    • informing Users about courses, academies, and subscription-related services;
    • improving service quality and the User experience;
    • marketing and promotional activities.
  • Brainster applies appropriate technical and organizational measures to protect personal data from unauthorized access, misuse, loss, or destruction. In processing data, Brainster may engage third-party processors (such as payment processors, IT service providers), but only on the basis of contracts ensuring compliance with statutory data protection standards.
  • The User has the right, at any time, to request access to their personal data, correction, deletion, or restriction of processing, as well as the right to object and to data portability in accordance with the law. Any request concerning these rights may be submitted in writing to Brainster via the official contact channels published on the website.

9. Dispute Resolution

  • Brainster and the User agree that they will first attempt to resolve any misunderstandings, disagreements, or disputes that may arise from these Terms or in connection with the use of the AI@Work platform services amicably, through direct negotiation and cooperation in good faith.
  • If the dispute cannot be resolved through negotiations within thirty (30) days of its occurrence, either party may seek resolution before the competent court in the Republic of North Macedonia.
  • The governing law for all disputes arising from these Terms or from the use of services shall be the law of the Republic of North Macedonia.
